These terms and conditions outline the rules and regulations for the use of On The Case’s Website.

By accessing this website we assume you accept these terms and conditions in full. Do not continue to use On The Case’s website if you do not accept all of the terms and conditions stated on this page.

The following terminology applies to these Terms and Conditions, Privacy Statement and Disclaimer Notice and any or all Agreements: “Client”, “You” and “Your” refers to you, the person accessing this website and accepting the Company’s terms and conditions. “The Company”, “Ourselves”, “We”, “Our” and “Us”, refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves, or either the Client or ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services/products, in accordance with and subject to, prevailing law of Pakistan. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same.

Refund Policy

We want you to be happy with your purchase. If you are not completely satisfied, you can return the product to us and we will either repair / replace it or a full refund, subject to the terms below. This policy applies to products bought from On The Case and nothing in this policy is intended to limit your statutory rights in any way.

 

In general, you can return an unwanted product to us at no charge, provided:

  1. It is undamaged and unused, with the original labels and stickers still attached;
  2. It is in the original packaging, which must be undamaged and in its original condition with all seals still intact (if applicable).
  3. It is not missing any accessories or parts;
  4. You request a return within 7 days of delivery to you or collection by you of the unwanted product. After 7 days you can only return a product if it is defective within 6 months from delivery to or collection by you.

 

The cost to return an unwanted item is for the clients account. Our courier is entitled to refuse collection of a product that is not properly packaged for transport.

Once we have inspected the product and validated your return, we will credit your account with the purchase price of the product within 7 days of the return (or refund you if that is your preference - A store credit will be given for all amounts less than R350).  Please bear in mind that refunds can take 5 - 10 working days to reflect in your account.

To the extent permitted by applicable laws On The Case shall not be responsible or liable for such data or for any loss cost, liability, damages or expenses caused and or suffered as a result of any use of and/or posting of and/or appearance on this website.
  3. On The Case reserves the right to monitor all data and to remove any data which it considers in its absolute discretion to be inappropriate, offensive or otherwise in breach of these Terms and Conditions.
  4. You warrant and represent that:
    1. You are entitled to post Photos and other data on our website and have all necessary licenses and consents to do so;
    2. The Photos do not infringe any intellectual property right, including without limitation copyright, patent or trademark, or other proprietary right of any third party;
    3. The Photos do not contain any defamatory, libellous, offensive, indecent or otherwise unlawful material or material which is an invasion of privacy
    4. The Photos will not be used to solicit or promote business or custom or present commercial activities or unlawful activity.
  5. You hereby grant to On The Casea non-exclusive royalty-free license to use, reproduce, edit any of your Photos in any and all forms, formats or media.

 

Content Liability

We shall have no responsibility or liability for any content appearing on your Web site. You agree to indemnify and defend us against all claims arising out of or based upon your Website. Please note that any such access request may be subject to a payment of a legally allowable fee.

You have the right to ask us to update, correct or delete your personal information. We will require a copy of your ID document to confirm your identity before making changes to personal information we may hold about you. We would appreciate it if you would keep your personal information accurate.

Definition of personal information

According to the Act ‘‘personal information’’ means information relating to an identifiable, living, natural person, and where it is applicable, an identifiable, existing juristic person.  Further to the POPI Act, COR Concepts also includes the following items as personal information:

  • All addresses including residential, postal and email addresses.
  • Change of name – for which we require copies of the marriage certificate or official change of name document issued by the state department.
